Benana Music Studios Ltd operates under the trading names “Benana Music Studio” and “Benana Music Studios.”
All services are supplied by Benana Music Studios Ltd (“we”, “us”, “our”).
2. Scope of Services
These Terms apply to all services provided by Benana Music Studio Ltd, including:
- Private and paired lessons (in-person or online)
- “Bring-a-Mate” and group sessions
- Workshops and showcases
- Recording sessions and other studio-based educational services
Instrument hire services are not provided by Benana Music Studio Ltd.
Such services are operated by Pure Rehearsal Studios Ltd, an independent company.
Benana Music Studio Ltd may help you express interest or arrange the initial booking by collecting your details through a form or administrative process, but:
- All payments, hire agreements, and related terms are entered directly between you and Pure Rehearsal Studios Ltd.
- Benana Music Studio Ltd acts solely as a facilitator and promoter, not as a contracting or payment party.
- Benana accepts no responsibility for the provision, quality, or terms of hire managed by Pure Rehearsal Studios Ltd.
3. Agreement to Terms
By registering, booking, or paying for any lesson, class, or service, you (“you”, “your”) agree to be bound by these Terms together with our:

For students under 18, consent from a parent or legal guardian is required before lessons can begin.
4. Legal Capacity & Parental Consent
Students under 18 must have the consent of a parent or legal guardian, who will be responsible for compliance with these Terms and for all associated payments.
5. Booking Systems
Lessons and services are booked and managed via MyMusicStaff (our primary system).
Some ad-hoc bookings (e.g., recording sessions, vouchers) may be managed manually via email, phone, or Google Calendar.
All confirmed bookings are subject to these Terms regardless of the booking method used.
6. Payments & Billing
- All payments are processed securely through Stripe via the MyMusicStaff student portal.
- Payment by bank transfer may be accepted only by prior agreement (for bulk bookings or vouchers).
- Cash payments are not accepted unless expressly agreed.
- All lesson and service prices are listed inclusive of VAT.
- If our VAT status changes, updated prices will be communicated in advance.

7. Privacy & Data Protection
- We handle all personal data in accordance with the UK GDPR and the Data Protection Act 2018.
- Our lawful bases include contract, legitimate interests, and consent (for optional marketing and media use).
- Key data processors include: MyMusicStaff (Canada – adequacy approved), Stripe, QuickBooks, and Google Workspace.
- We do not sell or share your personal data with third parties for marketing purposes.

8. Attendance, Behaviour & Conduct
- Students are expected to arrive on time and behave respectfully towards teachers, staff, and other students.
- Teachers will wait up to 10 minutes after the scheduled start time; beyond that, the lesson may be marked as missed and charged in full.
- Food or drink (except water) is not permitted near instruments or recording equipment.
- Smoking, vaping, or use of illegal substances is strictly prohibited on any Benana Music Studio premises.
- Please respect local noise limits and ensure studios are vacated promptly at the end of your booking.
- Benana reserves the right to withdraw services if a student or parent behaves inappropriately or breaches safeguarding, safety, or conduct expectations.
9. Cancellations & Refunds
- Cancellations made at least 24 hours in advance are eligible for a credit or refund as per our Payment & Refund Policy.
- Cancellations made within 24 hours of the scheduled time are chargeable in full.
- If we cancel a lesson, you will receive a full credit or refund.
- No refunds are issued for late arrivals, partial attendance, or dissatisfaction after a completed lesson.

10. Liability & Insurance
- Benana Music Studio Ltd holds full Public and Employer’s Liability Insurance.
- We are not liable for accidental loss, damage, or injury to persons or personal property while on our premises, except where required by law.
- Students participate at their own risk and must use instruments and equipment responsibly.
- Benana is not liable for any injury arising from improper use of instruments, cables, or equipment, or from failure to follow teacher instructions.
- For under-16s, Benana’s duty of care applies only during scheduled lesson times while the student is on site.
- Parents/guardians remain responsible before and after each session.
11. Intellectual Property
- All teaching materials, exercises, and arrangements created by Benana teachers remain the intellectual property of Benana Music Studio Ltd.
- Students may retain copies of materials provided for personal study and practice only.
- Unauthorised reproduction, resale, or public distribution of these materials is prohibited.
12. Recording & Archiving
- Lesson or performance recordings made by Benana may be securely archived for educational, safeguarding, quality, or marketing purposes with consent.
- Recordings are retained for up to 24 months, or longer if required for safeguarding, quality review, or marketing (with active consent).
- They are then securely deleted unless renewed consent is given.
- Students may record their own lessons only with teacher consent and must not post such recordings publicly without written permission.
13. Disclaimer & Limitation Liability
- Progress depends on practice, commitment, and individual ability.
- While our teachers provide professional guidance, Benana Music Studio Ltd cannot guarantee specific performance outcomes, grades, or exam results.
- The information provided by Benana Music Studio Ltd on this website, in lessons, and through other communications is for educational and general information purposes only. Benana Music Studio Ltd is not liable for any loss, damage, or injury arising from reliance on the information or participation in activities. Music instruction is provided under each student’s agreement and individual responsibility.
- Benana Music Studio Ltd does not provide medical advice. Any references to breathing, posture, or vocal health are for educational purposes only. Students should consult a qualified medical professional regarding any health concerns.
14. Force Majeure (Events Beyond Control)
- Benana Music Studio Ltd will not be held liable or deemed in breach of these Terms for delays or failures arising from events beyond our reasonable control, including but not limited to illness, accidents, transport disruption, strikes, pandemics, floods, or power failures.
- If such events prevent a lesson or service from taking place, affected sessions may be moved online, rescheduled, or credited/refunded as appropriate.
15. Termination of Lessons
- Either party may end lessons at any time by notifying the other in writing (email or message).
- All future Auto-Pay charges will stop upon cancellation, and any remaining credits or balances will be handled according to our Payment & Refund Policy.
16. Dispute Resolution
- We aim to resolve all issues promptly and informally.
- If a disagreement arises, we will first seek to resolve it directly.
- If that is not successful, either party may request mediation through an independent service such as the Small Business Commissioner or the Musicians’ Union, before any formal legal action is taken.
17. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England.
The courts of England will have exclusive jurisdiction over any dispute arising from these Terms.
18. Updates to Terms
- We may update these Terms periodically to reflect legal, operational, or system changes.
The latest version will always be available at www.benana.studio. - Continuing to book or attend lessons after an update takes effect constitutes acceptance of the revised Terms.
